Terms and Conditions of Service

1. Service Provision & Installation

• Serviceability: Installation is subject to area serviceability and technical ocular inspection.

• Installation Fee: A one-time installation fee (as specified in your plan) must be settled before or upon installation.

• Equipment Ownership: All network devices (modem/ONU, routers, drop cables) remain the property of Opticore Network and Data Solution. These must be returned in good working condition upon account termination.

2. Subscription & Billing

• Lock-in Period: Standard plans carry a 12-month lock-in period. Early termination will incur a fee equivalent to the remaining months of the contract or a fixed pre-termination penalty.

• Billing Cycle: Monthly Recurring Fees (MRF) are due on the 30th of every month.

• Late Payments: Failure to pay within 5 daysof the due date may result in automatic temporary disconnection. A reconnection fee will apply.

3. Service Levels & Repairs

• Reliability: We aim for 99% network uptime. However, service may be interrupted due to scheduled maintenance, fiber cuts beyond our control (e.g., accidents/calamities), or power outages.

• Technical Support: We provide 24/7 remote support and on-site dispatch during business hours (Monday–Saturday).

• Prohibited Acts: Subscribers are strictly prohibited from:

  • Reselling bandwidth to third parties without a commercial MOA.

  • Tampering with or relocating Opticore-owned equipment without prior consent.

  • Using the service for illegal activities (hacking, piracy, etc.).

4. Relocation & Transfer

• Requests for relocation are subject to serviceability in the new area and a relocation fee.

5. Data Privacy

• In compliance with the Data Privacy Act of 2012 (RA 10173), Opticore will protect all personal subscriber information and will not share it with third parties without consent, except as required by law.

6. Limitation of Liability

• Opticore is not liable for any loss of data or business income resulting from service interruptions caused by "Force Majeure" (e.g., typhoons, earthquakes) or third-party fiber cuts.

• Restricted Access: Only authorized Opticore personnel can access subscriber files.

• Secure Storage: Digital records are stored on encrypted servers, and physical forms are kept in secured cabinets.

4. Disclosure of Information

We do not sell or share your personal data with third parties for marketing. We only disclose information when:

• Required by Philippine law or a valid court order.

• Necessary to process payments through authorized banking partners.

• Coordinating with local authorities during emergencies or fiber infrastructure repairs.

5. Your Rights as a Data Subject

Under the Data Privacy Act, you have the right to:

• Access: Request a copy of the data we have on file for you.

• Correction: Ask us to update or correct any wrong information (e.g., a change of contact number).

• Erasure: Request the deletion of your data after your contract is terminated and all accounts are settled.
